Situation

A European national and a Thai national were preparing to marry. Both held assets in their respective home countries and were uncertain how a Thai pre-marital agreement would interact with European property law.

What We Did

We drafted the agreement under Thai civil law with explicit annexure notes on the limits of enforceability in the foreign jurisdiction. Each party was consulted separately. The document was bilingual from the first draft.

Outcome

Agreement signed and notarised. Both parties reported confidence that the document reflected their actual intentions rather than a standard template. Matter closed within three weeks of first consultation.

Mediation Engagement — Property and Children

Duration: 6 weeks, four sessions

Situation

A Thai couple was separating after eleven years of marriage. The primary concerns were a shared property in Chiang Mai and a custody schedule for two young children. Both parties wanted to avoid court if possible.

What We Did

We represented one party through four mediation sessions held over six weeks. The pace was set by what the parties could discuss at each meeting. The settlement covered property division and a detailed parenting schedule.

Outcome

A written settlement was produced, reviewed by both parties' legal representatives, and registered. The arrangement has remained in place for over a year with no further legal involvement.

Full Divorce Mandate — Cross-Border Assets

Duration: approx. 5 months

Situation

An Australian national and a Thai national were divorcing after a marriage that had produced two children. The Australian held a property in Queensland and the couple had a jointly owned condominium in Chiang Mai. Parental arrangements required careful attention.

What We Did

We took on the full mandate, including filing, property allocation under Thai law, and negotiation of parental arrangements. Cross-border asset considerations were addressed in the judgment documentation, with notes on enforcement in Australia.

Outcome

Final judgment obtained after approximately five months. The Thai property was allocated; the overseas property was addressed by agreement between parties. Parental schedule documented and registered. The client reported feeling fully prepared at each stage.
