"Chakra Counsel", "we", "us", or "our" refers to Chakra Counsel, a legal practice registered in Chiang Mai, Thailand.
"Client" or "you" refers to any individual or entity who accesses our website or engages our services.
"Services" means the legal services we offer, including Pre-Marital Agreement Drafting, Mediation Support Engagement, and Full Divorce Mandate.
"Engagement" means a formal service instruction entered into between Chakra Counsel and a Client, documented by a signed engagement letter.
"Website" means chakraac.pro and all associated pages.
2. Acceptance of Terms
By accessing or using our website, or by formally engaging our services, you confirm that you have read and understood these Terms and agree to be bound by them.
Our services are available to individuals aged 18 and over who have the legal capacity to enter into binding agreements. By proceeding, you represent that you meet these requirements.
If you are accessing the site on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
3. Services
Chakra Counsel provides family legal services in Thailand, including the three principal services described on our website. All services are subject to a formal engagement process and the execution of an engagement letter prior to substantive work commencing.
We serve clients in Thailand and, where permitted by applicable rules, clients based abroad who have a matter connected to Thai law. We reserve the right to decline any instruction at our professional discretion.
Service availability may vary. We will communicate any limitations openly before or at the time of engagement.
4. User Responsibilities
When using our website or engaging our services, you agree to:
- Provide accurate and complete information to the best of your ability
- Notify us promptly of any changes to information you have shared
- Use our website only for lawful purposes
- Refrain from any conduct that may interfere with the operation of our website or the integrity of our practice

Documents and instruments drafted on your behalf as part of a formal engagement remain the product of that engagement. Their use outside the scope of your matter should be discussed with us.
6. Payment Terms
Fees for our services are quoted in Thai Baht (฿) and are set out in your engagement letter. The indicative service fees displayed on our website are subject to confirmation at the time of engagement.
- A retainer or deposit may be required prior to work commencing
- Invoices are payable within the timeframe specified in your engagement letter
- Disbursements (such as court filing fees and notarisation charges) are billed separately at cost
- All payments are to be made in Thai Baht unless otherwise agreed in writing
Refunds are considered on a case-by-case basis according to the stage of work completed and the terms of your engagement letter. Advance retainer amounts are typically non-refundable once substantive work has commenced, unless otherwise agreed.
7. Engagement Terms
Each client engagement is governed by a written engagement letter, which takes precedence in the event of any conflict with these general Terms. Key aspects include:
- Scope of work and deliverables, agreed in writing prior to commencement
- Timelines, which are estimations and subject to court schedules, third-party responsiveness, and the evolution of your matter
- A duty of confidentiality, which we take seriously and uphold throughout and following any engagement
- Communication expectations, including your preferred channels and update frequency
Changes to the scope of an engagement will be confirmed in writing before additional work is undertaken. We aim to keep you well-informed throughout so that decisions can be made with clarity.

Our liability in connection with any engagement is limited to the fees paid under that engagement. This limitation does not apply in cases of wilful misconduct or gross negligence on our part.
We are not responsible for delays or failures in performance arising from circumstances beyond our reasonable control, including but not limited to court closures, regulatory changes, or third-party delays.
10. Termination
Either party may terminate an engagement by providing written notice in accordance with the terms of the engagement letter. We will advise you clearly on any implications that may arise from termination at a particular stage of your matter.
We may withdraw from an engagement if instructed to act in a manner inconsistent with our professional obligations, if fees remain unpaid after due notice, or if the relationship of trust necessary to act effectively can no longer be maintained.
On termination, we will provide a clear account of work completed and fees due, and will cooperate reasonably in any transfer of your matter to alternative representation.
11. Dispute Resolution
These Terms are governed by the laws of the Kingdom of Thailand. In the event of any dispute arising out of or in connection with these Terms or a service engagement, the parties will first seek to resolve the matter through good-faith discussion.
If informal resolution is not achieved within 30 days, the matter may be referred to mediation, and if still unresolved, to the competent courts of Chiang Mai Province, Thailand.
12. General Provisions
Entire agreement. These Terms, together with any engagement letter, constitute the entire agreement between the parties in relation to their subject matter.
Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
No waiver. A failure to enforce any right under these Terms does not constitute a waiver of that right.
Assignment. You may not assign your rights or obligations under these Terms without our prior written consent.

13. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via a notice on our website, and the effective date will be updated accordingly. Continued use of our website or services after such changes constitutes acceptance of the updated Terms.
